These Terms and Conditions ("Terms") govern your use of services provided by Jayesh Trans Movers ("Company", "we", "us"), a logistics and freight transport company operating across India, registered under MSME. By booking or using our services, you agree to these Terms in full.
1. Services
Jayesh Trans Movers provides road freight transport services including Full Truck Load (FTL), Part Truck Load (PTL), Over Dimensional Cargo (ODC), Door-to-Door delivery, and express freight across India. Service availability is subject to route feasibility, cargo type, and vehicle availability at the time of booking.
2. Booking & Confirmation
- All bookings must be confirmed in writing (email, WhatsApp, or written order).
- A booking is considered confirmed only after we issue a written acknowledgement or consignment note (LR/GR).
- We reserve the right to refuse any booking at our discretion, including prohibited or hazardous goods not declared in advance.
- Estimated transit times are provided in good faith and are not guaranteed unless agreed in writing.
3. Cargo & Packaging
- The customer is responsible for ensuring all goods are adequately packed and labelled for road transport.
- We accept no liability for damage caused by inadequate packaging.
- Prohibited items include: illegal goods, live animals, explosives, flammable materials without prior written approval, and any goods restricted under Indian law.
- The customer must declare the accurate nature, weight, and value of goods. Mis-declaration may result in cancellation and additional charges.
4. Freight Charges & Payment
- Freight charges are agreed at the time of booking and are subject to change if cargo details differ from those declared.
- Additional charges may apply for waiting time, re-delivery, detention, route deviations, or toll/permit changes beyond our control.
- Payment terms are as agreed in the service contract. Default payment is due within 7 days of invoice unless otherwise agreed.
- Late payments attract interest at 18% per annum from the due date.
- GST is applicable on all services as per prevailing Indian tax laws.
5. Liability & Claims
- Our liability for loss or damage to cargo is limited to the declared value of the goods, subject to a maximum of ₹2,00,000 per consignment.
- We are not liable for: indirect or consequential losses, delays due to force majeure (floods, strikes, accidents, government restrictions), or damage caused by the inherent nature of the goods.
- All claims for loss or damage must be made in writing within 7 days of delivery (or scheduled delivery for loss claims). Claims not made within this period will not be entertained.
- Photographic evidence and original packaging must be preserved for damage claims.
6. Cancellation & Modification
- Cancellations made more than 24 hours before scheduled pickup are free of charge.
- Cancellations within 24 hours of scheduled pickup may attract a cancellation charge equivalent to 15% of the agreed freight.
- If a vehicle has been dispatched and the booking is cancelled, full freight charges may apply.
7. Force Majeure
We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, civil unrest, government actions, fuel shortages, road closures, or vehicle breakdowns.
8. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes arising from our services shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Vapi, Gujarat.
9. Amendments
We reserve the right to update these Terms at any time. Continued use of our services after any change constitutes your acceptance of the new Terms.
